1. Website and Online Services
These Terms of Service (“Terms”) govern your use of builtonpurposestudio.com (the “Site”) and the online services made available by Built On Purpose Studio through or in connection with the Site.
Built On Purpose Studio (“Built On Purpose Studio,” “we,” “us,” or “our”) is a photography studio based in Plano, Texas.
Our Site and related online services may allow users to:
* Learn about our photography services
* Contact us or submit inquiries
* Book photography sessions
* Schedule appointments
* Sign photography agreements and other documents
* Receive and pay invoices
* Access client galleries
* View, select, favorite, download, or share photographs and videos
* Purchase digital images, prints, and other photography products
* Apply for or access information about the Built On Purpose Studio Partner Program
* Access or complete Partner Program applications, agreements, or related documentation
* Access other photography-related services or information we may make available
We use Pixieset Media Inc. (“Pixieset”) as a primary technology provider for our website, client management, booking, payments, galleries, image delivery, online store, and certain Partner Program administration.
By accessing or using the Site or our online services, you agree to these Terms.
If you do not agree to these Terms, you should not use the Site or our online services.

2. Photography Services and Client Agreements
These Terms govern use of the Site and our general online services.
Specific photography services are governed by the applicable photography agreement, proposal, invoice, booking terms, model release, license, or other agreement between you and Built On Purpose Studio (collectively, a “Client Agreement”).
A Client Agreement may include terms relating to:
* Photography services
* Session dates and locations
* Fees and retainers
* Cancellations and rescheduling
* Image delivery
* Copyright
* Client image-use rights
* Model releases
* Portfolio or promotional use
* Event coverage
* Other terms specific to the photography services being provided
If there is a conflict between these Terms and a Client Agreement concerning photography services covered by that Client Agreement, the Client Agreement will control with respect to those services.

3. Partner Program
Built On Purpose Studio may offer a Partner Program that includes opportunities such as Referral Partners and Portfolio Models.
Information presented on the Site regarding the Partner Program, including program descriptions, eligibility, benefits, expectations, referral commissions, Portfolio Sessions, photography opportunities, or other program features, is provided for general informational purposes and may be changed or discontinued by Built On Purpose Studio as permitted by applicable agreements and law.
Submission of a Partner Program application does not guarantee acceptance or participation. Built On Purpose Studio may evaluate applicants according to its current program needs, eligibility criteria, creative needs, and other reasonable considerations.
Participation in the Partner Program requires execution of the applicable written agreement, which may include a Referral Partner Agreement, Portfolio Model Agreement and Continuing Model Release, or another applicable program agreement (collectively, a “Partner Agreement”).
A Partner Agreement may include terms relating to:
* Program eligibility and participation
* Program term and renewal
* Referral activity and referral codes
* Referral commissions
* Promotional or social media expectations
* Portfolio Model exclusivity
* Portfolio Sessions and photography opportunities
* Photography provided to participants
* Copyright and image-use rights
* Model releases
* Portfolio, advertising, promotional, publication, or other authorized uses
* Termination and early termination
* Other terms specific to the applicable Partner Program role
The applicable Partner Agreement governs the participant’s specific rights and obligations in connection with the Partner Program.
If there is a conflict between these Terms, general information presented on the Site, and an applicable Partner Agreement concerning participation in the Partner Program, the Partner Agreement will control with respect to that participation.

4. Pixieset Services
Our Site and many of our online photography services are provided through Pixieset.
Depending on how you interact with us, Pixieset may provide or support services including:
* Website hosting
* Contact forms
* Client relationship management
* Partner Program applications and agreements
* Booking and scheduling
* Contracts and questionnaires
* Invoicing
* Online payments
* Client galleries
* Photograph and video delivery
* Image selections and favorites
* Digital downloads
* Online store functionality
* Print and product ordering
* Other photography-related services
Your use of features provided through Pixieset may also be subject to Pixieset’s own terms, policies, and technical requirements.
We are not responsible for outages, errors, interruptions, data loss, security incidents, or other failures caused solely by Pixieset or another independent third-party service provider, except to the extent responsibility cannot lawfully be excluded.

5. Booking Photography Services
Photography services may be booked through our Site, Pixieset Studio Manager, direct communication with Built On Purpose Studio, or another method we authorize.
Submitting a booking request does not necessarily guarantee availability or acceptance.
A photography booking becomes binding according to the applicable Client Agreement, booking terms, invoice, payment requirements, and other documentation associated with the service.
You are responsible for providing accurate and complete information when booking photography services.
Pricing, retainers, payment schedules, cancellation terms, rescheduling terms, and other service-specific conditions are governed by the applicable Client Agreement or booking documentation.

6. Client Galleries
We use Pixieset Client Gallery to host and deliver photographs and videos.
Depending on the gallery and services provided, authorized users may be able to:
* View photographs or videos
* Select favorites
* Make image selections
* Download digital files
* Share gallery content
* Purchase digital images
* Purchase prints or other products
* Access other gallery features
Some galleries may be protected by passwords, download PINs, access codes, or other security controls.
If you receive gallery credentials, you are responsible for using reasonable care when sharing them.
You may not attempt to:
* Access a gallery you are not authorized to access
* Circumvent gallery security
* Obtain unauthorized downloads
* Interfere with gallery functionality
* Use another person’s credentials without permission
Gallery availability is not guaranteed indefinitely.
Gallery expiration dates, download availability, image delivery, archival periods, and other gallery-specific matters may be governed by the applicable Client Agreement or Partner Agreement.

7. Digital Image Downloads
Digital photographs or videos made available for download are licensed or provided according to the applicable Client Agreement, Partner Agreement, gallery terms, or license associated with the content.
Unless expressly stated otherwise, downloading an image does not transfer copyright ownership.
You may use downloaded images only as permitted by the applicable license or agreement.
You may not:
* Sell or sublicense images unless expressly authorized
* Claim authorship of photographs created by Built On Purpose Studio
* Remove copyright notices where applicable
* Use images unlawfully
* Use images in a manner prohibited by an applicable Client Agreement, Partner Agreement, model release, or license
Additional restrictions may apply depending on the photography service or program involved.

8. Pixieset Store
We use Pixieset Store to sell digital images, photographic prints, and other photography products.
Product availability, sizes, finishes, pricing, and fulfillment options may vary.
When you place an order, you are responsible for providing accurate:
* Contact information
* Billing information
* Shipping information
* Product selections
* Other information necessary to complete the transaction
Orders may be fulfilled by third-party photographic laboratories, print providers, shipping companies, or other vendors.
Colors, cropping, print appearance, and physical product characteristics may vary slightly from how images appear on a screen due to differences in displays, printing processes, materials, and production methods.

9. Payments
Payments for photography services, retainers, invoices, digital images, prints, products, and other transactions may be processed through Pixieset, Stripe, or other payment methods we make available.
You agree to provide accurate and authorized payment information.
By submitting payment information, you represent that you are authorized to use the applicable payment method.
Payment processors may impose their own terms and policies.
Built On Purpose Studio does not directly store complete payment-card numbers or card security codes on our own systems.
Payment obligations relating to photography services are governed by the applicable Client Agreement or invoice.
Payment and commission matters relating to the Partner Program are governed by the applicable Partner Agreement.

10. Cancellations, Rescheduling, and Refunds
Cancellation, rescheduling, refund, retainer, and payment policies for photography services are governed by the applicable Client Agreement, booking terms, invoice, or other documentation associated with the photography service.
Termination, early termination, or other withdrawal from the Partner Program is governed by the applicable Partner Agreement.
Unless otherwise required by law, digital products that have already been delivered or downloaded may be nonrefundable.
Print and physical product refund or replacement requests may be subject to Pixieset Store policies, fulfillment-provider requirements, product condition, and the circumstances of the request.
Nothing in these Terms modifies any cancellation, rescheduling, refund, termination, or payment provision contained in an applicable Client Agreement or Partner Agreement.

11. Copyright and Ownership
Unless otherwise stated in a written agreement, Built On Purpose Studio or the applicable photographer retains copyright in photographs and videos created by Built On Purpose Studio.
Purchasing photography services, receiving digital files, participating in the Partner Program, or purchasing prints does not automatically transfer copyright ownership.
Clients, Portfolio Models, and other authorized recipients receive only the usage rights granted by the applicable:
* Client Agreement
* Partner Agreement
* License
* Model release
* Gallery terms
* Written authorization
You may not reproduce, sell, license, commercially exploit, materially alter, or otherwise use copyrighted content beyond the rights granted to you.

12. Portfolio, Promotional, and Social Media Use
Built On Purpose Studio may use photographs, videos, and other content for portfolio, website, social media, advertising, promotional, publication, competition, exhibition, or other purposes when authorized by an applicable Client Agreement, Partner Agreement, model release, license, or other permission.
The scope of any such authorization is governed by the applicable agreement or release.
Nothing in these Terms independently grants Built On Purpose Studio rights to use a person’s likeness beyond rights provided by an applicable agreement, release, license, or law.
When content is published through social media platforms or third-party websites, those platforms may independently process, store, display, redistribute, or otherwise handle the content according to their own terms and policies.

13. Acceptable Use
You agree not to use the Site, client galleries, Partner Program systems, online store, booking systems, or other services to:
* Violate any law or regulation
* Infringe intellectual-property rights
* Harass, threaten, or harm another person
* Submit fraudulent or misleading information
* Attempt unauthorized access to accounts, galleries, or systems
* Circumvent security or access controls
* Introduce malware or harmful code
* Scrape, harvest, or collect information without authorization
* Interfere with the operation or security of the Site or services
* Use our photographs, videos, trademarks, branding, or other content beyond the rights granted to you
* Impersonate Built On Purpose Studio or another person
* Misrepresent your relationship with Built On Purpose Studio
* Use referral codes, Partner Program materials, or other program resources in a fraudulent, misleading, unauthorized, or abusive manner
* Engage in any activity that could reasonably damage the Site, our services, our clients, our Partners, or Built On Purpose Studio
We may restrict or terminate access to online services where we reasonably believe these Terms have been violated.
Participation in the Partner Program may also be suspended or terminated as provided in the applicable Partner Agreement.

14. User-Submitted Information
When you submit information through the Site, Studio Manager, Partner Program applications, contracts, questionnaires, booking forms, galleries, store, or other online services, you agree to provide information that is accurate to the best of your knowledge.
You are responsible for ensuring that you have authority to provide information relating to other individuals.
For example, if you provide information regarding family members, children, event participants, Portfolio Models, or other people, you represent that you are authorized to provide the information where authorization is required.
Submission of information does not transfer ownership of your personal information to Built On Purpose Studio.
Our handling of personal information is described in our Privacy Policy.

15. Minors
Our photography services and Portfolio Model Program may involve minors.
A parent, legal guardian, or other authorized adult may be required to enter into applicable agreements, provide consent, manage communications, authorize photography, or control gallery access on behalf of a minor.
Participation by a minor in the Portfolio Model Program is governed by the applicable Partner Agreement, including any requirements concerning parent or legal guardian consent and participation.
Users under 13 should not independently submit personal information through our general Site forms without appropriate parental or guardian involvement.

16. Third-Party Services and Links
Our Site and online services may use, integrate with, or link to third-party services including:
* Pixieset
* Stripe
* Metricool
* Social media platforms
* Print laboratories
* Fulfillment providers
* Shipping providers
* Other technology or service providers
We do not control independent third-party services.
Your use of third-party services may be subject to their own:
* Terms of service
* Privacy policies
* Refund policies
* Security practices
* Operational requirements
We are not responsible for the content, availability, privacy practices, security, or operation of independent third-party services.

To the fullest extent permitted by law, the Site and general online services are provided on an “as is” and “as available” basis.
We do not guarantee that:
* The Site will always be available
* Online services will be uninterrupted
* Client galleries will remain available indefinitely
* Third-party platforms will operate without error
* Website content will always be complete or current
* Technical errors will never occur
* Every Partner Program applicant will be accepted
* Any particular Partner Program opportunity, referral, commission, Portfolio Session, or other benefit will be available except as expressly provided in an applicable Partner Agreement
Specific obligations relating to photography services are governed by applicable Client Agreements.
Specific obligations relating to Partner Program participation are governed by applicable Partner Agreements.
Nothing in this section excludes warranties or obligations that cannot lawfully be excluded.

19. Limitation of Liability
To the fullest extent permitted by applicable law, Built On Purpose Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site or general online services.
We are not responsible for losses caused solely by:
* Internet outages
* Device failures
* Third-party platform failures
* Unauthorized sharing of gallery credentials by a user
* Third-party payment processor failures
* Third-party shipping or fulfillment delays
* Events outside our reasonable control
Liability relating to photography services may also be subject to limitations contained in an applicable Client Agreement.
Liability relating to Partner Program participation may also be subject to provisions contained in an applicable Partner Agreement.
Nothing in these Terms limits liability where limitation is prohibited by law.

20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Built On Purpose Studio, its owners, employees, contractors, and representatives from claims, damages, liabilities, and expenses arising from:
* Your unlawful use of the Site or online services
* Your violation of these Terms
* Your infringement of another person’s rights
* Information you submit without appropriate authority
* Your misuse of photographs, videos, galleries, downloads, Partner Program materials, referral codes, or other content
This provision does not require indemnification for conduct for which indemnification cannot lawfully be required.
Any additional indemnification obligations relating to photography services or Partner Program participation are governed by the applicable Client Agreement or Partner Agreement.

21. Changes to the Site or Services
We may modify, suspend, replace, or discontinue portions of the Site or our general online services at any time.
We may also modify:
* Website content
* Photography service descriptions
* Pricing displayed on the Site
* Booking functionality
* Gallery features
* Store offerings
* Partner Program descriptions or application availability
* Third-party service providers
* Other online functionality
Changes to Site content do not retroactively modify an existing Client Agreement or Partner Agreement unless expressly agreed by the parties or otherwise permitted by the applicable agreement or law.

22. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Site, photography services, Partner Program, online services, business practices, technology providers, or legal requirements.
When we update these Terms, we will revise the “Last Updated” date.
Changes apply prospectively unless otherwise stated or required by law.
Changes to these Terms do not retroactively modify a separate Client Agreement or Partner Agreement unless expressly agreed by the parties or otherwise permitted by that agreement or applicable law.
Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

23. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes relating solely to these Terms or use of the Site will be subject to the jurisdiction of courts located in or serving Collin County, Texas.
Separate Client Agreements or Partner Agreements may contain additional dispute-resolution, jurisdiction, or venue provisions that govern disputes arising under those agreements.

24. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

25. Entire Agreement Regarding Site Use
These Terms, together with our Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement governing general use of the Site and online services.
Photography services may be subject to separate Client Agreements.
Partner Program participation may be subject to separate Partner Agreements.
If there is a conflict between these Terms and an applicable Client Agreement or Partner Agreement regarding matters specifically governed by that separate agreement, the applicable Client Agreement or Partner Agreement will control with respect to those matters.
